Your data will be handled responsibly and in accordance with the applicable data protection regulations on our website. Our integrated and confidential handling of your personal data should always be comprehensible and transparent for you. In this data protection declaration we inform you which data we collect from you on which legal basis, for which purposes we use it and to which recipients we pass it on.

Obligation to provide information when collecting personal data pursuant to Art. 13 EU GDPR

In the following we will inform you in accordance with Art. 13 EU GDPR how we collect and process your personal data in accordance with the law.

1. Processing of personal data

In various forms on our website, your personal data is collected and processed:

  • "Newsletter Subscription"

When you subscribe to our newsletter, we collect your name and e-mail address. We process this data for the purpose of regularly informing you about our auctions and company-related news in our newsletter. You can unsubscribe from the newsletter at any time via the unsubscribe link at the end of the e-mail.

  • "Contact"

When you use our contact form, we collect your name, address, e-mail address and telephone number. We process these data for the purpose of establishing contact, i.e. to process your questions or suggestions and, at your request, also to inform you about an auction of your property by our company.

  • "Order catalogue"/"Cancel catalogue"/"Change of address"

If you use the form to order or cancel our catalogue and the form to change your address details, we will record your name, address, e-mail address and telephone number. We process these data for the purpose of dispatching our auction catalogue.

  • "Object questionnaire.

If you use our property questionnaire, we record your name, address, e-mail address, telephone number, property address, information regarding the category of the property to be sold, as well as optional land register information (e.g. parcel or size of plot), property details (e.g. year of construction or energy certificate) and other documents submitted by you (e.g. pictures of the property). We process this data for the purpose of the initial assessment and pre-evaluation of your property as a first step to a potential sale of your property at one of our auctions.

The legal basis results from Art. 6 para. 1 lit. b) GDPR in conjunction with § 1 of the Auctioneer Ordinance - VerstV.

The auctioneer may only auction on the basis of a written contract with the contents according to sentence 2. The contract must contain:

  1. First name, surname and address of the client,
  2. the designation of the individual items and rights intended for auction, except in the case of groups of items, if the principal has waived the designation of the individual items in the contract,
  3. the amount of a fee to be paid by the principal,
  4. the amounts to be paid by the contracting authority as a proportion of the costs and cash outlays of the auction and for an estimate and appraisal,
  5. the amount to be paid by the principal to the auctioneer if he withdraws the order in whole or in part,
  6. information about

a) how long the principal is bound to the contract, b) whether and what minimum prices are fixed, c) whether gold and silver objects can be awarded below the gold or silver value.

  • Online participation in an auction

If you want to participate online in one of our auctions, you have the possibility to place your bids before the live auction via the Internet in a closed data space. In this case, we will record your user ID, password and name in our bidding portal,

Address, date of birth, tax ID number, email address, phone number and fax number. These data are mandatory for the conclusion of a sales contract. The legal basis for the pre-contractual processing of your personal data results from Art. 6 Para. 1 lit. b) GDPR.

This data is first used for the purpose of your identification. With the start of the auction, you then enable the responsible employee to submit your online bids as part of the bidding steps up to your predetermined highest bid.

The provision of all personal data mentioned by you takes place on a voluntary basis.

If we employ external service providers for the technical implementation of data processing, these will act exclusively on our instructions and in accordance with our specifications, which are specified in a contract for order data processing (ADV) (Art. 28 EU GDPR).

2. Legal basis for data processing

The legal basis according to which we process the above-mentioned personal data is Art. 6 para. 1 sentence 1 lit. b) lit. 2 of the European Data Protection Regulation (EU GDPR). Accordingly, the processing is lawful if it is necessary for the implementation of pre-contractual measures taken at the request of the data subject.

3. Duration of storage and transfer of your personal data

Your personal data will be deleted if they are no longer required for the purposes for which they were collected or otherwise processed (Art. 17 para. 1 lit. a) EU GDPR).

Of course, you have the right that all data that we have processed from you will be deleted at your request, unless there is a legal retention period.

The personal data collected by us are processed exclusively within the European Union. A passing on to states outside the union is not allowed.

4. Recipients/categories of recipients of personal data

In order to send you catalogues, we will forward your addresses to a partner company for delivery as part of order processing (Art. 28 EU GDPR). Your personal data collected and processed by us will not otherwise be passed on to third parties.

An automated processing of personal data under evaluation of the personal aspects in relation to a natural person (profiling) does not take place.

5. Your rights regarding your personal data processed by us

You will receive information about your stored data from us at any time (Art. 15 EU GDPR). If your data are inaccurate or have been collected unlawfully, you have the right to have them corrected or deleted (Art. 16, 17 EU GDPR) and to limit the processing (Art. 18 EU GDPR). You also have the right to data transferability (Art. 20 EU DSG Regulation) and opposition (Art. 21 EU GDPR).

6. Right of appeal to the competent supervisory authority

7. Integration of social networks

In terms of social networking, you can connect to our Twitter account and YouTube channel from our website, and vice versa. Otherwise social networks are not used.

8. Email security

If you send us an email, your email address will only be used for correspondence with you and, if applicable, for sending our newsletter. An encryption procedure is not used. Please note that confidential information should not be exchanged via email because of the risk of eavesdropping or viewing. In case of doubt, please use our postal address or fax number to send us confidential information.

9. Links

Our website contains links to other websites. We do not have any influence on their contents and on the fact that their operators keep the data protection regulations.

10. Security

Deutsche Grundstücksauktionen AG uses technical and organisational security measures in accordance with Art. 32 EU GDPR in order to protect the data you provide against accidental or intentional manipulation, loss, destruction or access by unauthorised persons. Our security measures are continuously improved in line with technological developments.

11. Cookies

We use cookies on various pages to make visiting our websites attractive and to enable the use of certain functions. These are small text files that are stored on your computer and do not cause any damage. Most of the cookies used by us are deleted from your hard disk after the end of the browser session (so-called session cookies). Other cookies remain on your computer and enable us to recognize your computer during your next visit (so-called long-term cookies). These cookies are used to greet you with your user name and save you from having to re-enter your password or fill out forms with your data for subsequent orders. You can set your browser so that you are informed when cookies are set and only allow cookies in individual cases, accept cookies for specific cases or generally exclude them and activate automatic deletion of cookies when the browser is closed. In view of the discussion about the use of analysis tools with complete IP addresses, we would like to point out that this website uses Google Analytics with the extension "_anonymizeIp()" and therefore IP addresses are only processed in abbreviated form in order to exclude direct personal references.
